According to Phillips, “don’t ask, don’t tell” is a violation of the 1st amendment. Phillips also ruled that the military’s anti-gay policies do not aid military readiness, denying an argument from supporters of the ban. Phillips will issue an injunction that bars the government from continuing DADT. The USDOJ can appeal if they wish. The Los Angeles Times quoted the reaction of R. Clarke Cooper, director of the Log Cabin Republicans & Liberty Education Fund, who said, “[The] ruling is not just a win for Log Cabin Republican service members, but all American service members.”
