TRENTON – The Mercer County judge who last week ordered the state to begin allowing gay couples to marry starting on Oct. 21 has set up a schedule for further arguments.
Judge Mary Jacobson ordered that the state’s application requesting a stay of her order must be filed by the end of business today, and any opposition to that request has to be filed by Friday.
Any further legal replies would be due by Monday.
On a parallel track, Senate Democrats on Monday said they want the state Supreme Court to take up the case right away.
The administration also on Monday requested the state high court take up the issue.
In addition to the two legal paths, the Senate Democrats said Monday that they will still pursue a veto override vote of the gay marriage bill, because they said judicial rulings might still leave some aspects of the bill unaddressed.
