The NYPD has been criticized for its uneasy relationship with the city's cyclists. As this video from Fox 5 shows, the apple does not fall far from the tree, as Greg Kelly grills DOT Commissioner Janette Sadik-Khan for what one might expect to be a celebratory interview about the city's new bikeshare program. Instead of a helmet, the commissioner should have brought a pair of boxing gloves.

The unmarried host gave special thanks to his loyal female co-anchor.

"I'm especially grateful, again, to this lady who sits next to me everyday, Rosanna Scotto," Mr. Kelly said, "You ready to get back to work?"

"I'm so happy you're back," Ms. Scotto said.

Mr. Kelly reached for her hand, and applause could be heard off-screen.

"Just, watch it, because we're going right back to where we left off," she teased.

"Really? Well, I'm not too sure about that," Mr. Kelly replied. "I don't know if I want to work too hard today. It's Friday."

Asked to weigh in, meteorologist Mike Woods said he too was happy to have Mr. Kelly back.

"I wanna know where that tie came from too," Mr. Woods said. "Come back looking good, he's sharp, he's good to go."

“Earlier today, the District Attorney’s Office sent a letter to Andrew Lankler notifying him that we would not be filing charges against his client. We made a similar notification to the complainant. From the moment this matter was referred to this Office, we conducted a thorough investigation, consistent with standard practice. That investigation included interviewing numerous fact and expert witnesses, and reviewing and analyzing multiple items of physical evidence, including, but not limited to, receipts, security logs, text messages, and telephone records. After reviewing all the evidence, we have concluded that the established facts do not constitute a crime under New York criminal law.”

The letter Mr. Kelly's lawyer Andrew Lankler received was essentially the same, except signed by Martha Bashford, chief of the Sex Crimes Unit in the D.A.'s office.

The accusations against Mr. Kelly were reported after his accuser's boyfriend became angry with her following the revelation of relations with him. Since then, the New York Post reported that the accuser had a 48-hour "marathon" of sexting with Mr. Kelly within the timeline of the alleged rape (the Post also yielded a column by Andrea Peyser in which she derided Mr. Kelly's anonymous accuser). Needless to say, this all created bold fodder for the city's tabloids.

This isn't exactly the first time in recent memory Manhattan D.A. Cy Vance has been handed a high-profile sex scandal involving powerful figure—in August, rape charges were dropped against former International Monetary Fund chief Dominique Strauss-Kahn—and far from the first time he'd met Mr. Kelly, whose show he had been on only days before the investigation into the charges began.

The commissioner’s face was stoic, betraying no emotion to the assembled members of the print and television media gathered in the lobby of Bellevue Hospital Center late Tuesday night.

Just minutes before Mr. Kelly arrived to the podium with Mayor Mike Bloomberg, those members of the press exchanged anecdotes to one another about their work covering the alleged rape case involving Greg Kelly, Mr. Kelly’s son and a well-known TV personality on Fox 5’s “Good Day New York.”

There was no mention of Greg’s name in the press conference. Instead, the commissioner calmly laid out the circumstances surrounding the shooting of 29-year-old Officer Brennan, a six-year veteran of the force, who chased a suspect into the hallway of the Bushwick Houses in East Williamsburg, Brooklyn, and narrowly escaped death.

At 9 p.m. this evening, Officer Brennan and two other officers, all plainclothes members of Brooklyn Patrol Borough North’s anti-crime unit, were responding to radio calls of shots fired in the vicinity of 140 Moore Street.

When responding, they encountered three individuals fleeing from that location and the officers gave chase. Officer Brennan followed one individual whom all three officers recognized from “past encounters,” said Mr. Kelly.

That man, later identified as 21-year-old Luis “Baby” Ortiz, ran into the rear entrance of 370 Bushwick Avenue, part of the Bushwick Houses, a housing project, with Officer Brennan running behind him.

In a very short distance between the two, Mr. Ortiz “turned and fired one shot, striking officer Brennan in the base of the skull,” said Mr. Kelly.

Officer Brennan fired one shot in return, which was believed to not have struck Mr. Ortiz.

As this was happening, Officer Brennan’s two colleagues had difficulty opening the door to the rear entrance of 370 Bushwick Avenue that apparently closed after Officer Brennan followed Mr. Ortiz inside the building, Mr. Kelly said. The two heard both shots being fired and forced the door open, discovering the wounded Officer Brennan on the ground.

Mr. Ortiz then escaped to the fifth floor of the building as responding members of the NYPD’s Emergency Service Unit started their search for the young suspect.

He was later arrested in apartment 5A in 390 Bushwick Avenue, a building close to where the shooting took place. Mr. Kelly said that Mr. Ortiz was also wanted for questioning in connection with a homicide that happened earlier in January.

Officer Brennan, meanwhile, was rushed to Bellevue Hospital Center. There, Dr. Ronald Simon and his staff of trauma surgeons used fluid and pressure to excrete the bullet from just behind his right ear, said Dr. Eli Kleinman, the supervising chief surgeon of the NYPD.

He was conscious throughout the entire procedure, said Mr. Kelly, and was later joined by Officer Brennan’s parents and wife Janet, who just 6 weeks ago gave birth to a baby girl named Maeve.

In a macabre moment during the press conference, Mr. Kelly asked Dr. Kleinman to hand him the plastic container holding the bullet.

Mr. Kelly took the plastic evidence bag from Dr. Kleinman and removed the container, its insides bloody from the bullet that had been just moments ago been removed from Officer Brennan’s skull.

“He is one lucky young man,” said Mr. Kelly, holding the container up for the press to see.

Indeed, Officer Brennan was lucky. On December 12th in Cyprus Hills, Brooklyn, Police Officer Peter J. Figoski and his partner were responding to calls of a robbery in progress when he was shot in the face by suspect Lamont Pride as he was trying to escape.

The bullet struck Officer Figoski below his left eye and exited the back of his head. He was rushed to Jamaica Hospital, where he was pronounced dead five hours after being shot.

Officer Brennan, who was alert and talking with doctors and his visitors following his surgery, was expected to make a full recovery.

For Mr. Kelly, the shooting was just the latest test in a particularly trying period in his otherwise vaunted tenure as police commissioner. His son, recently accused of rape, is being investigated by the Manhattan District Attorney’s Office. He and Deputy Commissioner of Public Information Paul Browne caught the ire of the Muslim community for Mr. Kelly’s appearance in “The Third Jihad,” a controversial documentary on American Muslims (which Mr. Browne gave conflicting statements explaining Mr. Kelly’s involvement in the film).

But there, in his hands, was a container holding that bullet that nearly claimed the life of another one of his men. Luckily for Officer Brennan and for Mr. Kelly, Mr. Ortiz had aimed poorly.

An unnamed law enforcement source has told the New York Post that the young woman accusing Greg Kelly of rape texted with him afterwards. The source described a "star-struck" fan who told Mr. Kelly she'd seen him on TV and said he was "so cute." The source said after Mr. Kelly and the woman first met they exchanged "explicit" texts, calling the period "two days of foreplay." Then the alleged assault occurred and:

"They continued to text," the source said. "Part of it was about arranging another date."

In total, there were 17 text messages between the two.

"You don't text your rapist — other than to say, 'You're awful,'" the source said.

The victim claimed she was so drunk she could not say no.

Greg Kelly is the son of police commissioner Ray Kelly and the Post reported that the victim's brother is a sergeant with the N.Y.P.D.

To avoid the appearance of impropriety, police have ceded investigation of the case to the Manhattan D.A.

Greg Kelly has been out of the public eye and on open-ended leave from his anchor duties on Fox5's  "Good Day New York" since the case was first publicly reported on January 26.

His reaction, one which requires few words on his part, is that of a man barely able to control his seething hatred of the moment he's living in:

Mr. Vance appeared on the show Monday with Dan Reingold, president of the Hebrew Home in Riverdale, to talk about the growing problem of elder abuse.

But towards the end of the interview (4:21 in the video), Mr. Kelly changes the subject and asks Mr. Vance about his office's failure to prosecute Dominique Strauss-Kahn (a.k.a. "DSK") for allegedly sexually assaulting hotel maid Nafissatou Diallo inside The Sofitel Hotel.

"Fundamentally, Greg, it's a prosecutor's obligation, I believe, to put before a jury in a criminal case those cases where we are convinced as an office beyond a reasonable doubt that we are both able to prove the case and understand what happened," said Mr. Vance.

"Our job as a prosecutor's office is not to put points on the board," he adds. "Our job as a prosecutor's office is try to do right, to pursue every case to where it should end up appropriately, wherever that is."

Mr. Kelly then asks:

"Ms. Diallo, was she treated fairly by your office? Newsweek had a story and it seemed like she was undergoing a great deal of questioning, some have raised a concern that perhaps if she were a more prominent citizen, member of the community, she would not have been subjected to that kind of interrogation."

"Greg, I think that's... I don't know who is communicating that to you, but I believe that's a misimpression and incorrect assessment of the case," said Mr. Vance.  "I think we look at every case carefully."

Mr. Kelly's accuser reported the alleged assault to police at the 13th precinct Tuesday night, The NY Daily News reports. The woman, who is believed to be "around 30," said she had drinks with Mr. Kelly, 43, at the South Street Seaport on October 8th of last year before he allegedly assaulted her inside the law firm office where she worked.

Given Mr. Kelly's ties to the NYPD —his father is Police Commissioner Ray Kelly— the case is being investigated by Cy Vance's office. Mr. Kelly has not been criminally charged.

Mr. Kelly did not appear on Good Day New York today following these accusations.

The New York Times is reporting that the Manhattan District Attorney is investigating charges of sexual assault leveled at WNYW (Fox) anchor Greg Kelly. Mr. Kelly, son of New York Police Commissioner Raymond Kelly, allegedly committed the act in October 2011 in Lower Manhattan.

Mr. Kelly issued a denial through his attorney, Andrew Lankler:

"Mr. Kelly is aware that the New York County District Attorney's office is conducting an investigation," the statement said. "Mr. Kelly strenuously denies any wrongdoing of any kind, and is cooperating fully with the district attorney's investigation. We know the district attorney's investigation will prove Mr. Kelly’s innocence."

According to the Times, Mr. Kelly's accuser reported the incident at the 13th Precinct station on Tuesday. She said she met Kelly on October 8 and had drinks then went to her office, where she said the rape occurred.

The victim told police her boyfriend found out and in his anger confronted police Commissioner Ray Kelly about it during a public function. After the irate boyfriend supposedly told Commissioner Kelly that his son had "ruined" his girlfriend's life. The commissioner told him to write a letter about it.

To avoid any appearance of conflict of interest, the N.Y.P.D. has turned over investigation of the charges against Greg Kelly to the Manhattan D.A.
