Yesterday, Jen Carlson from Gothamist posted that she had it on "good authority" that legendary Bowery scene club CBGB was "alive in spirit" and was possibly looking for a new space to open in Manhattan. Which is so vague it could mean literally anything. Which already is a terrible sign.

When Hilly Kristal died in 2007, most of the money went to his daughter Lisa Kristal Burgman and the "spirit" of CBGB died a little death with every attempt to cash in on the infamous club's name: a Las Vegas spin-off that never opened; a John Varvatos store for tourists in the historic landmark; a second Morrison Hotel gallery devoted entirely to photography from the club that was stillborn when the Morrison closed.

Brooklyn Vegan took Gothamist's tip and added fuel to the fire by pointing out that a CBGB Twitter account that "claims to be official"  had tweeted earlier this month, "Who would you like to see at the #CBGB Music Festival this summer? No band to big or to small."

The tweet has since been deleted. Take from that what you will. The New York Observer has reached out to the person behind the CBGB website as well as Ms. Kristal Burgman, but has yet to receive an official response.

For anyone who lives in the city, the iconic "I Love New York" logo usually brings to mind millions of tourists streaming into Times Square like so many locusts descending on a neon crop field. There are entire stores in the city dedicated to selling products featuring the image of a heart where the l-word should be. (For a visual example, look at the image to your left.)

But the "I Love New York" brand is more than just a cheesy tourist item: it's a state-owned logo that made $1.83 million dollars in licensing fees this year alone. Which when you think about it, is really creepy. You don't usually go into stores like Macy's or Saks and expect your money to be going right back into the state government's biggie bank, but that's exactly what has been happening ever since New York began selling the trademark in 1994 to everyone from high-end couture lines to novelty shops. The state is even launching its own brand of "I Love New York" scene with perfume company Bond No. 9.

"I Love New York" is even making New York rich when it's sold out of state (or country). Samira Ali from CMG Worldwide, the state's licensing agent, told The New York Daily News, "We are huge in Japan. That is our second-largest market."

We're all for bolstering New York's tourism industry (which is where all the millions from the licensing deals are going), but it's a little Big Brother-y to have the state making deals with fashion lines and suing anyone who tries to use the "I Heart _" trademark without forking over dough. Especially since the logo was given to the state as a freebie by graphic designer Milton Glaser in 1975, and he's never seen one red cent off royalties for the iconic image.

According to Lam's attorney, Andrew M. Jaffe, private investigator Jimmy Robbins, who first contacted Lam, was working for Apple.

But when Jaffe called Robbins, he was informed that Robbins was off the case, and Apple was handling it personally. "Now we're just waiting to hear from them officially," said Jaffe.

Since The Observer broke this story, Lam has had a hectic couple days. "Traffic to the site this month is equal to all the other months combined," Lam told The Observer. "I am just overwhelmed with emails." 

The story of Lam's entreprenurial genius made news around the world and was picked up this afternoon by several major papers in China. However, it was not clear until now who exactly was going after Lam. "I'm feeling pretty stressed, knowing it's the Almighty Apple who is coming after me," Lam said.

The Observer has reached out to Apple for comment.
