A former mayoral candidate is hoping a Judge will order a special election in Evesham, where Councilwoman Jamie Montgomery resigned last night. By waiting until after 4:00 PM to resign, Montgomery hoped to avoid a special election this November to fill her seat. Rodger Nogaki, who ran for Mayor in 2003, is seeking an injunction to prevent the Council from filling Montgomery’s seat tonight. He argues that the vacancy was actually created on September 3, the date of her wedding to a local police officer. The couple bought property in Gloucester County in May; she sold her home in June and moved in with her mother until the wedding. Nogaki is saying that after that date, her intent was to live with her husband in Deptford, which would mean that she was no longer a legal resident of Evesham and thus ineligible to hold local office. Evesham is technically a non-partisan town with May elections, but traditionally both parties actively back slates of candidates.
