The Justice Department’s own guidelines on assigning DPAs, authored last year, were “carefully developed,” Grindler said, before adding that the legislation would create obstacles to issuing agreements efficiently.

“Requiring courts to approve a non-prosecution agreement before it takes effect requires separation efforts, and could impede the government’s efforts against corporate fraud,” he said.
