Swine Flu Victim’s Family Sues

The family of the first New York City resident to die of swine flu, Mitchell Wiener, has filed a $40 million suit against the city.

The suit alleges city officials “were negligent, careless, reckless, grossly negligent and violated Public Health Law” because they, among other things, failed to report “an outbreak of a communicable disease” in a timely fashion.
