Judge rules Lopez is a New Jerseyan

A Superior Court Judge ruled today that Nidia Lopez is a legal resident of Jersey City and can keep her City Council seat, the Jersey Journal is reporting. Two of Lopez's opponents in the May municipal race had alleged that she was ineligible because she had taken tax deductions available only to Florida residents and had not paid state income tax in New Jersey.

"Residence under our laws is determined by nothing more than intention confirmed by actual acts of living to such a degree that they reasonable show that the party intended the residence and his real and actual residence," Assignment Judge Maurice Gallipoli wrote in a sixteen page ruling, the Jersey Journal said.
