If Mercer County Sheriff Kevin Larkin winds up resigning over his most recent controversy, Republican Gov. Christopher Christie would appoint his replacement. Vacancies in constitutional offices – Sheriff, County Clerk, Surrogate (and in Essex and Hudson, Register of Deeds and Mortgages) – are filled by the Governor, with the advise and consent of the Senate. High on the list of potential replacements would be James McSorley, a retired state police captain and aide to U.S. Rep. Christopher Smith (R-Hamilton), who ran an aggressive challenge to Larkin in 2008. There would be a November 2010 special election to fill the remaining fourteen months of Larkin’s term.
