On Menendez recall, Judges took the easy way out

In New Jersey, where judges often baffle political insiders on election law matters, three state Appellate Court judges allowed a Tea Party group to move forward on their bid to force U.S. Sen. Robert Menendez into a recall election.  Judges Edwin Stern, Jack Sabatello and Ronald Graves essentially punted on the Menendez recall, banking on the inherent difficulty of getting 1.3 million signatures.  If the Tea Party surprises and comes up with the signatures, look for the matter to go to federal court – and out of reach for the state judiciary.
