The Bergen Record reports that all charges against Joseph Ferriero, Bergen County’s former top Dem turned party pariah, have been dropped.
“However, the judge on Thursday declined to decide whether Joseph Ferriero should get a new trial,” the site reports.
Ferriero was rung up on mail fraud and conspiracy charges last fall with cohort Dennis Oury, a former Bergenfield attorney, but was given a second life by a recent U.S. Supreme Court decision. Ferriero’s attorney, Joseph Hayden of Roseland, argued that the Supremes’ ruling narrowing the definition of “theft of honest services” should disqualify the charges against Ferriero; the judge agreed. The only question now is whether Ferriero will be re-prosecuted and if a judge would even entertain new charges.
Neither Hayden nor Ferriero were immediately available to comment.
