In a letter to Rivera-Soto, who has made himself a target by refusing to issue any rulings as a protest over the appointment of a substitute to fill in for Justice John Wallace, Codey requests that the Justice leave the court “immediately.:

Last year, Gov. Chris Christie refused to reappoint Wallace to the bench.  Chief Justice Stuart Rabner appointed a fill-in, while Democrats have refused to consider, Anne Patterson, Christie’s nominee to replace Wallace, until 2012 when Wallace would have been reached manadatory retirement.

Last week Rivera-Soto informed Christie that he will not seek reappointment when his term is up later this year, rendering himself irrelevant on the court.  Christie has said he will not nominate a replacement until the Senate agrees to consider Patterson.
