Julie Bolcer has the news about the New York City Clerk no longer requiring proof of sex from marriage applicants. The change in policy was prompted by a threatened lawsuit from a transgender couple who tried getting married in the Bronx.

From the City Clerk’s memo:

“Gender stereotypes or preconceived notions related to gender expression – including an applicant’s physical appearance, dress, behavior, or name – may not be considered wen deciding whether to issue a marriage license.

It is contrary to this policy to request any additional proof of sex when a valid government issued identification document from the list of approved documents has been submitted and the sex listed on such documents matches the applicants sex as indicated on the marriage application.”
