Medical malpractice bill clears committee

Bill A1982, which concerns liability, standards of care, and insurance coverage for medical malpractice actions, was  released with amendments Monday in the Assembly Health and Senior Services Committee.

The bill seeks to set time limits on claims being filed, providing that a malpractice action be commenced within two years after the plaintiff discovers an injury, but not more than four years after the date of the alleged act, with exceptions.

Among other things, the bill stipulates that a person giving expert testimony in such actions has to be licensed within the state of New Jersey.

Opponents argued that some aspects of the bill would make it impossible for some people to have access to the legal system, and would bar some legitimate claims from being dealt with.
