TRENTON – State Sen. Linda Greenstein (D-14) asked Phil Kwon to give his opinion on the Supreme Court’s decision in the Citizen’s United case, which treats corporations as people for the purposes of free speech.
“I do not believe it is appropriate for me to opine on a Supreme Court case, and whether or not I agree with that,” said Kwon during the Judiciary Committee hearing into his state Supreme Court nomination.
Kwon later stymied state Sen. Gerald Cardinale (R-39) when the veteran tried to ask the nominee about his opinion on past judicial decisions.
Cardinale then asked Kwon about his opinion regarding activist judges.
“That word activist means a lot of different things to a lot of different people,” said the nominee.
“Does the court have the authority to find something that is not there?”
“I could not properly give you an answer to that hypothetical without understanding what the nature of the case was,” said Cardinale.
