TRENTON – The West New York mayor has won a legal battle over the removal of two school board members.
The appellate court today affirmed an earlier decision removing Janet Passante and Alexander Locatelli.
Both had been appointed by a departing mayor on May 13, 2011.
Felix Roque became mayor on May 17, 2011.
In essence, the state Education commissioner found, and the court today agreed, that such appointments only can be made between April 1 and 15 with terms commencing on May 16.
The court also held that Locatelli – a sitting board member who was appointed to an unexpired term – should not have been appointed.
