TRENTON – The Supreme Court has announced that its ruling in the judges’ pension/benefits case will be released Tuesday at 10 a.m.
The decision in DePascale vs. New Jersey has been awaited for some time.
The issue is fairly basic – does the Pension and Health Care Benefits Act, which increases public employees’ contribution rates for their pension and healthcare benefits, diminish judicial salaries and thereby violate article VI of the New Jersey Constitution?
Its consequences could be far-reaching. Judges argue that they are protected from having their salaries interfered with while they are sitting on the bench, but the state, as part of its comprehensive overhaul last year of pensions and benefits for public workers, argued that pension contributions are not part of salaries.
