An appeals court in Newark will hear arguments Wednesday concerning the Christie administration’s efforts to take control of $162 million in affordable housing funds.

The appellate panel will hear oral arguments at 2 p.m. in the Veterans Courthouse, 50 W. Market St., Room 1114.

The state, via the Council on Affordable Housing, has said it has the right to seize the funds if municipalities fail to use the money within a set period of time.

The towns have argued the state prevented them from using the money because, in part, COAH essentially was dormant for two years, and because necessary direction from COAH never was given.

The Fair Share Housing Center won a stay of the state’s attempted seizure of the money, and the N.J. League of Municipalities has been given permission to participate in the arguments.
