Fernandez-Vina avoids specific comments on gay marriage issue

TRENTON – It didn’t take too long for someone to ask the question regarding the topical issue that hung over the Senate Judiciary Committee chambers today.

“Should two people of the same sex be allowed to marry,’’ Sen. Nicholas Scutari asked state Supreme Court nominee Judge Faustino Fernandez-Vina during his hearing today.

“It surely would be inappropriate for me to comment,’’ said the judge who if confirmed to the high court may soon have to preside over that very issue.

In addition, Scutari pressed the nominee on the issue of abortion, but as he has been doing throughout the hearing, Fernandez-Vina resisted attempts to have him comment on specifics.

Scutari repeatedly asked him about abortion, and Fernandez-Vina finally said: “Row vs. Wade is still the law of the land.”

The hearing occurs with the state waiting to see if the high court will issue a stay of a lower court ruling which had said gay marriage could be legal as of Monday.
